These Terms & Conditions govern the use of the DGWalaa platform by restaurants and their authorized users. By creating an account or using the service, you agree to these terms.
1. Accounts and Access
Restaurants are responsible for maintaining accurate account information and controlling access to their admin dashboard. You are responsible for actions taken under your account, including those of staff members who are given access. You should notify DGWalaa promptly if you suspect unauthorized access.
2. Restaurant Responsibilities
You remain fully responsible for your menu content, item descriptions, pricing, taxes, and any legal or regulatory obligations related to your food and beverage operations. DGWalaa provides the tools for displaying menus and accepting orders but does not control what you choose to publish or sell.
3. Acceptable Use
You agree not to misuse the platform, attempt to bypass security controls, interfere with other users, or use DGWalaa in connection with unlawful activities. Reverse engineering, automated scraping of non-public areas, or using the service to send spam or harmful content is not permitted.
4. Service Availability and Changes
DGWalaa aims to provide a reliable service but may occasionally perform maintenance, updates, or changes that affect availability. Features may evolve over time, and some capabilities may be added, modified, or removed. When significant changes impact core workflows, reasonable notice will be provided where possible.
5. Fees and Billing
If you subscribe to a paid plan, you agree to pay the applicable fees as described in your selected pricing plan. Fees, billing cycles, and refund rules will be described on the pricing page or in a separate agreement. Taxes may be added where required.
6. Limitation of Liability
To the fullest extent permitted by law, DGWalaa is not liable for lost profits, lost data, or indirect, special, or consequential damages arising from use of the service. Total liability for any claim related to the service is limited to the amount paid by the restaurant for the service during the 3 months preceding the claim.
7. Termination
You may stop using the service at any time. DGWalaa may suspend or terminate access if there is a serious or repeated breach of these terms, misuse of the platform, or non-payment of fees. Certain provisions, such as limitations of liability and payment obligations, may continue to apply after termination.
8. Governing Law
These terms will be governed by the laws of the relevant jurisdiction specified in your commercial agreement or, if none is specified, the jurisdiction where DGWalaa is primarily operated. Any disputes will be handled in that jurisdiction, unless local law requires otherwise.
